If you want to buy a home after you get your green card, mostly you will get after your retirement.

I don't want to feel "my home" when I am 68 and after my kids are out on their own. So I decided, dump the H1B, H4, 485, 131, 761, 797, 999, 888, I94, EAD, AP... AAD, CCD etc crap in trash, and bought the home.

I am happy. Even if I am asked to leave the country tomorrow, I just lock the door, throw the keys in trash and take off.

who cares when life matters.Exactly.Thats the way i think too.We might be spending an additional 500 on a mortgage But we get better comforts.Spending a good paortion of your age without comforts which ypou are eligible doesnt make sense. And if something fails let the bank have it.After all we spent Rs.20000 PM for additional comfort.

Seems to me that the problem as usual is that too many people qualify for EB2 thus slowing down "genuine" cases.

The solution to this is in the hands of the DOL. DOL can reduce the number of people qualifying for EB2 by simply doing away with the "business necessity" exception.

In other words without this exception, people will qualify for EB2 only if their field requires an advanced degree due to law (e.g. doctors) or if an advanced degree is customary in the profession (e.g. academia). This will reduce the flow to EB2 by disqualifying the large number of professions where an advanced degree is merely discretionary and not mandatory (e.g. MS, MBA)

But this is a very draconian measure and hopefully does not come into play.

I did not mention anything like that. Just a request to allocate some Visa Numbers to EB-3 (India), which is retrogressed in 2001 since many years. I modified that format letter.
Did you mentiopn like Phani_6 that your lawyer filed Eb3 on advice from DOL inspite of you qualifying for Eb2?

As someone who comes from an army family and who has been trained as a reserve, I want to assure you guys who think that an Indo-Pak war will linger; that it will not. It will take Indian army 15-20 days to reach Islamabad if the full force is deployed and the army is in charge of the war and not our politicians.
Pak has nukes, but their delivery mechanism is not sound and before Pak launches any nukes, US will disarm them and even if a few are launched India had a very good anti missile shield which will intercept and destroy all warheads before it enters Indian air.
Now to actual strategies that India should follow-
    1. The civilian government in Pak is not at fault, previously they were responsible for terrorist attacks on India but now they are suffering at the hands of a monster of their own making. Terrorism and ISI.
    2. India should use air and missile power to strike out and wipe out a 500km radius around each terrorist camps while offering an olive branch to the Pak govt. What this does is it will kill with certainty all terrorists and will also wipe out surrounding villages.
    3. These are casualties of war and are a necessary evil, it will strike fear in the hearts of villagers and when ever a terrorist camp is set up; the surrounding villagers will chase them out in fear of India's wrath.
    4. India should send RAW analysts to assassinate all rouge ISI officers, if needed Mossad of Israel can help India.
    5. Finally the only way to deal with the problem of Pakistan longtime is to either socially cleanse Pakistan for the civilian government and bring in more modernism or carve out pakistan into several independent states. This is a long term goal which has to be thought about.

If anyone is interested I can post the actual army strengths of India and Pak, its an interesting statistic and I am sure the Pak government knows about it in more detail than me. And it beats me that in spite of knowing the facts they are doing all this war posing. Just a tit bit from it, Indian army (only) is 1.3mil + 450K (reserves) strong. The combined Pak armed forces are 450K active + 500K reserves. India outnumbers Pak in almost every aspect 1:5 on an average. We have fought 4 wars and India has won all 4 times, why should the 5th time be any different? Lets finish this and move on, we have to become an economic superpower and we cannot be bothered by such trivial things like terrorism and pakistan. Lets take terror to the terrorists, like the song from the Hindi movie Arjun goes
" Dushman ko yeh dikadho dushmani hai kya..."

The Lobbying Disclosure Act of 1995 (http://www.senate.gov/reference/reference_index_subjects/Lobbying_vrd.htm) establishes criteria for determining when an organization or firm should register their employees as lobbyists. Lobbyists register with the Senate Office of Public Records (SOPR (http://www.senate.gov/pagelayout/legislative/one_item_and_teasers/opr.htm)). SOPR receives, processes, and maintains for public inspection records filed with the Secretary of the Senate (http://www.senate.gov/reference/office/secretary_of_senate.htm) involving the Lobbying Disclosure Act, the Federal Election Campaign Act (http://www.fec.gov/law/feca/feca.shtml), the Ethics in Government Act, the Mutual Security Act, and the Senate Code of Official Conduct. Those recognise him convert to christianity. They suffered because of their non belief. But details in the bible for the second coming of jesus and the nation of Israel to prepare for his coming, so the present day jews are supported by God. In the end they all belive the mesiah.

This is your religious belief/prophecy and ideology. This is nothing but neocons/zionists "The Greater Israel" or "Greater Middle East" plan. Exterminate muslims from their land and expand the occupation so that you can receive your messiah. As per their plan, Israel should expand upto Syria and this is what you believe. You know why muslims will not let go palestine that easily. If we loose Palestine today, tomorrow its Egypt and Syria.

Thats why these killings happen. Now you agree. Thats why you guys are killing school kids also. Because you see them as potential terrrorist. This is the truth. Thats why you guys act violently to acheive your goal.

I know you won't respond me anymore. Because you know your believe/ideology/prophecy/unjust acts will be exposed here.

A boy and his father (new immigrants in Canada), were visiting a shopping centre. They were amazed by almost everything they saw, but especially by two shiny, silver walls that could move apart and back together again. The boy asked his father: "What is this, Dad?" The father (never having seen an elevator) responded: "Son, I have never seen anything like this in my life, I don't know what it is."

While the boy and his father were watching wide-eyed, an old lady in a wheel chair rolled up to the moving walls and pressed a button. The walls opened and the lady rolled between them into a small room. The walls closed and the boy and his father watched small circles of lights with numbers above the walls light up. They continued to watch the circles light up in the reverse direction. The walls opened up again and a beautiful and attractive 24-year-old woman stepped out.
The father shouts to his son: "GO GET YOUR MOTHER!!!":D

Thanks for the quick reply. I never overstayed my I-94 either before leaving US or re-entering US. But just a thought... Do you mean if somebody covered by 245(i) and never left US after filing the labor before April 2001, still be eligible to adjust status?
    Thanks

    Yes.

A little unknown thing is that even if you get married to someone who is eligible for 245i; you also get that benefit. Even if someone divorced a person who was eligible for 245i; they still get the benefit.

Therefore, someone who has overstayed, out of status and marries someone who had a labor or 130 pending before april 30, 2001 (even though this person was never out of status or overstayed); then spouse can claim 245i benefit.

    Interviewer: How come?

Stroustrup: You are out of touch, aren't you? Remember the typedef?

    Interviewer: Yes, of course.

Stroustrup: Remember how long it took to grope through the header files only to find that 'RoofRaised' was a double precision number? Well, imagine how long it takes to find all the implicit typedefs in all the Classes in a major project.

Interviewer: So how do you reckon you've succeeded?

Stroustrup: Remember the length of the average-sized 'C' project? About 6 months. Not nearly long enough for a guy with a wife and kids to earn enough to have a decent standard of living. Take the same project, design it in C++ and what do you get? I'll tell you. One to two years. Isn't that great? All that job security, just through one mistake of judgement. And another thing. The universities haven't been teaching 'C' for such a long time, there's now a shortage of decent 'C' programmers. Especially those who know anything about Unix systems programming. How many guys would know what to do with 'malloc', when they've used 'new' all these years - and never bothered to check the return code. In fact, most C++ programmers throw away their return codes. Whatever happened to good ol' '-1'? At least you knew you had an error, without bogging the thing down in all that 'throw' 'catch' 'try' stuff.

Interviewer: But, surely, inheritance does save a lot of time?

Stroustrup: Does it? Have you ever noticed the difference between a 'C' project plan, and a C++ project plan? The planning stage for a C++ project is three times as long. Precisely to make sure that everything which should be inherited is, and what shouldn't isn't. Then, they still get it wrong. Whoever heard of memory leaks in a 'C' program? Now finding them is a major industry. Most companies give up, and send the product out, knowing it leaks like a sieve, simply to avoid the expense of tracking them all down.

    Interviewer: There are tools...

Stroustrup: Most of which were written in C++.

Interviewer: If we publish this, you'll probably get lynched, you do realise that?

Stroustrup: I doubt it. As I said, C++ is way past its peak now, and no company in its right mind would start a C++ project without a pilot trial. That should convince them that it's the road to disaster. If not, they deserve all they get. You know, I tried to convince Dennis Ritchie to rewrite Unix in C++.

Interviewer: Oh my God. What did he say?

Stroustrup: Well, luckily, he has a good sense of humor. I think both he and Brian figured out what I was doing, in the early days, but never let on. He said he'd help me write a C++ version of DOS, if I was interested.

    Interviewer: Were you?

Stroustrup: Actually, I did write DOS in C++, I'll give you a demo when we're through. I have it running on a Sparc 20 in the computer room. Goes like a rocket on 4 CPU's, and only takes up 70 megs of disk.

Interviewer: What's it like on a PC?

Stroustrup: Now you're kidding. Haven't you ever seen Windows '95? I think of that as my biggest success. Nearly blew the game before I was ready, though.

Interviewer: You know, that idea of a Unix++ has really got me thinking. Somewhere out there, there's a guy going to try it.

Stroustrup: Not after they read this interview.

Interviewer: I'm sorry, but I don't see us being able to publish any of this.

Stroustrup: But it's the story of the century. I only want to be remembered by my fellow programmers, for what I've done for them. You know how much a C++ guy can get these days?

Interviewer: Last I heard, a really top guy is worth $70 - $80 an hour.

Stroustrup: See? And I bet he earns it. Keeping track of all the gotchas I put into C++ is no easy job. And, as I said before, every C++ programmer feels bound by some mystic promise to use every damn element of the language on every project. Actually, that really annoys me sometimes, even though it serves my original purpose. I almost like the language after all this time.

Interviewer: You mean you didn't before?

Stroustrup: Hated it. It even looks clumsy, don't you agree? But when the book royalties started to come in... well, you get the picture.

Interviewer: Just a minute. What about references? You must admit, you improved on 'C' pointers.

Stroustrup: Hmm. I've always wondered about that. Originally, I thought I had. Then, one day I was discussing this with a guy who'd written C++ from the beginning. He said he could never remember whether his variables were referenced or dereferenced, so he always used pointers. He said the little asterisk always reminded him.

Interviewer: Well, at this point, I usually say 'thank you very much' but it hardly seems adequate.

Stroustrup: Promise me you'll publish this. My conscience is getting the better of me these days.

Interviewer: I'll let you know, but I think I know what my editor will say.

Stroustrup: Who'd believe it anyway? Although, can you send me a copy of that tape?

    Interviewer: I can do that.

You are right, different areas will bottom at different times. But it's relatively easy to judge whether your area has bottomed or not:

    1. Check if the rents and mortgage payments for the comparable properties are similar. Remember to own a house you need to have sterling credit history + come up with 20% down. So your mortgage payment + tax + insurance should at least be equal to rent if not less because you are paying premium in terms of putting 20% down which renters do not have to do.

    2. Bubble began forming around 2000 to 2002 depending on the area. Check past sales prices for comparable homes in the same area around that time because prices back then were still realistic. If the asking price now is same as the price then + 1-2.5% price appreciation per year to adjust for inflation then it's a reasonable price. Ignore the peak around 2005-2006.

If your purchase price meets both these criteria you know you have a good deal. Go ahead and buy.

If you have only been reading all the doomsday articles on the net about another nosedive in the realestate market, then I must suggest you to step out and smell the coffee. Other than in a few areas like Detroit and Miami, the home prices are close to stable and are not heading to fall another 10%. When people write articles they want to sensationalize thier reports. What's happening in Detriot will not be happening everywhere in the nation. Real estate markets are very local and cannot be generalized. So anyone that is thinking that there is going to be another HUGE drop in home prices are mistaken.

Yes, you are right, absolutely no one can time the market. That is why it is a great strategy not to speculate, but go by the fact that real estate prices are affordable now and interest rates are the lowest in recent history. Don't think that just because there was a bubble you'll now get good homes for anything more than 5% discount.

Remember that you probably have a job in the city you live in, and that you are continually employed, means that there are other people around you with jobs. They are ready to snap up homes even before you get to see it from the inside. I see homes that are in bad shape in my county (Fairfax, VA) sitting in the market for months. But the ones that are good goes under contract in less than a week.

The letter is trying to say either of two things from heart

    1) Employer / DOL/ Lawyers cheated us by filing us under EB3 even though the job posting was well qualified for Eb2.

    2) Employer / DOL/ Lawyers were Naive so ended up filing us under EB3 even though the job posting was well qualified for Eb2.

So now CIS can compensate us since we are waiting in line for so many years. In old times when the system was so inefficient and now you have cheated us by improving the system and people have sneaked past us? All this might be true but when you are presenting a legal case these things do not stand a chance of being accepted.

The right way will be to remove all references to Eb2 accept the fact that you consented to be in Eb3 so you should take all the pro's and con's associated with it. After that we can all write letters to CIS and all others under guidance of IV higlighting the endless waits and how visa recapture will help this mess. Dont make comparisons with Eb2 to justify your case because it isnt right and if you feel it is right then why just Eb2 why not EB1 after all they get GC in 1-2 years flat.

I would like to first applaud Pani for this effort. I strongly support his initative. I think his letter is original and from his heart. It is more authentic and human than what some on this forum are suggesting here. I think his gut feeling on this one is more important than the calculated steps IV has been taking so far.
These kind of authentic letters from members like pani would give IV a more strong foundation to focus their energy. I think all those who want to write letters to the President, Senator, Congressmen, USCIS, DOL, DOS, DOJ, etc should do so and also should write the letter on their own instead of copying one. The reasons, sentiments and purpose will add more flavour to the whole thing. I would go one step further to suggest that some should write the letter in Spanish, French, Mandarin, Hindi, Urdu, etc, etc, if they think that they can express themselves better in their own language.
Pani once again I would like to say that you are doing the right thing.

PS: When the ship is sinking everyone wants to escape but the one who is aggresive to save himself has more chance of living than the other who is waiting for someone to save him.

Moving fast: Tech lobbyist races to results (http://thehill.com/business--lobby/moving-fast-tech-lobbyist-races-to-results-2007-12-11.html) By Kevin Bogardus | The Hill, December 11, 2007

I really dont have a strong partisan style. I just like getting things done, said Hellmann.

Under his helm, the lobbying team at the Information Technology Industry Council (ITI) has earned a reputation as a smart and aggressive advocate on Capitol Hill for the high-tech cause.

Hellmann, 46, joined ITI in 2001 after several years advising House Republican leaders, including then-House Speaker Dennis Hastert (R-Ill.). But politics was not always foremost on the Florida natives mind. He describes himself as a former beach bum who did not vote in the 1980 presidential election because he could not choose between Ronald Reagan and Jimmy Carter.

Now I know better, Hellmann said.

By college, Hellmanns interest in Washington had begun to simmer. He majored in political science and says he typically flipped to C-SPAN instead of MTV. In 1984, he took a job as a paid intern to then-Rep. Buddy MacKay (D-Fla.).

Hellmann soon after switched sides and began to move up the ranks. He worked for several prominent GOP lawmakers, such as Rep. Newt Gingrich (Ga.), before becoming a key adviser to party leadership. There, Hellmann helped to push through welfare reform, anti-poverty legislation and the No Child Left Behind Act.

The lobbyist always strived for results in Congress and saw the need for both parties to work together. Hellmann put that philosophy into practice as the liaison between then-House Majority Whip Tom DeLay (R-Texas) and the coalition of Blue Dog Democrats.

He knows substance, but even more importantly, he knows the institutional quirks and the process as well as anybody in town, said Rep. Adam Putman (Fla.), the House Republican Conference chairman. Putnam credits Hellmann with educating members on how the technology sector is a driver of the economy.

As ITIs senior vice president of government relations, Hellmann says it is not difficult to lobby for his trade groups members corporations like Dell and eBay since they are the coolest companies in the world.

We call it the wow effect, said Hellmann. But gone are the days when high-powered executives for tech companies could fly into Washington once a year, meet with lawmakers and expect to achieve what they wanted on Capitol Hill, according to the lobbyist. Now, a daily, active presence is necessary to keep check on Congress, which can affect the industry on multiple fronts.

Increasingly, other well-heeled business lobbies with decades of experience in Washington are weighing in against tech companies interests. We have to match them in shoe leather, said Hellmann.

Adam Kovacevich, Googles Washington spokesman, described Hellmann as an excellent advocate for the tech cause a good consensus-builder who has a great understanding of what is actually possible on the Hill.

He has never stopped building relationships with new generations of staff, said Kovacevich, who worked at ITI in 2005.

To maintain ITIs lobbying prowess, the trade group executive has helped assemble a team of type-A personalities who can work with both parties and understand how Congress works. Each lobbyist has between five and 10 years of government service, Hellmann estimated.

With Rahm, we moved a million miles a minute and we got things done. I felt ITI worked the same way, said Jon Hoganson, who recently joined ITI from House Democratic Caucus Chairman Rahm Emmanuels (Ill.) office. It wasnt about white papers and setting up meetings.

Hellmann credits ITIs quick action with helping to convince Congress to set a date for the country to move from analog to digital television. The trade group and its member companies formed the DTV Coalition, and stressed in Hill meetings that the sale of spectrum bandwidth could generate $10 billion in federal revenue, according to Congressional Budget Office estimates.

More recently, ITI has waded into the emotional battle over immigration. Hellmanns German-born parents came to America in 1956 on his fathers employment visa, so the debate has special resonance for the lobbyist.

There is a strong nativist element in Washington right now, said Hellmann. Republicans have weighed in against immigration reform.

Democrats, meanwhile, have railed against trade deals, another ITI priority.

With so much on the trade groups plate, Hellmann plans to keep ITI up to date on Washingtons happenings and sees no need to slow down.

Politics is a fast-moving sport, Hellmann said.

I had lot of hopes for skilled immigrants under the democratic majority both in house and senate. They are now slowly waning. As I see it, the democratic party in US (elsewhere except South) is now taken over by union and leftist liberalsl in the South it is hijacked by Blue Dog Democrats. I see no hope.

DailyKos is a liberal activist group, with a LOT of influence on Democrats of all hues. Why, most Senators, Congressmen, Presidential Candidates regulary start threads, discussions etc.

Go there and see that is going on. (http://www.dailykos.com/story/2007/4/30/95526/3669)

Though the discussion is mostly on H1B, there are few gems on Green Cards. This one particularly caught my mind.

While I don't dispute the overall study, it may not reflect the current market. As someone who places software engineers, I'm finding it hard to find well trained people and companies often reject them before we get to the price negotiation stage. A lot of the people we find are on H1-Bs or have green cards. We are searching in the same pools as everyone else (and with our own sources as well) so it's not like we are selecting by place of origin. So, it looks to me from admittedly annecdotal evidence that there really is a shortage of native talent.

I think a part of this is because the ranks of U.S. engineers were virtually obliterated in the last seven years by the downturn. Many of those people simply left the field. Engineers who were here from India and other countries on H1-Bs got sent home, but they quickly found jobs that were outsourced to their countries. That means that their job skills continued to improve, while people in the U.S. found jobs (if they could) at Mervins and Wal-Mart. They left the Valley in droves.

The result is that it is very difficult to find people with current skills if they have been living in the U.S. And those who would possibly re-enter the market are justifiably gun shy about moving back to Santa Clara County.

This includes a large number of women (and men, for that matter) who decided that the downturn was an opportune moment to stop working and have a baby. It's difficult to cover up a two- or three-year gap in your resume. Companies want to find people with current skills. This is partly related to another, negative, change--the unwillingness of companies to invest in their "human capital." They won't train anyone on their own dime if they can get away with not doing it.

The U.S. needs to jumpstart the local tech worker group by putting some real muscle behind the effort. That means more than job training. We have to fund internships or something that will get these people real job experience on current products.

Oh, and then there's the whole pay scale thing. Would you live in Silicon Valley on $35/hour? If you didn't have a family, then probably no problem. That is to say, if you are here on an H1-B from India, then you'd scramble to get the job. But if you have a non-working partner or more than one child, then you are probably not going to leave Nebraska for the hot lights of Redwood Shores. At least you wouldn't if you had any idea what it costs to live in Redwood City. Start by bringing a couple hundred K to plunk down on your new home--average price somewhere north of a half million.

    Think, liberally.

IV should totally change its strategy; drop all activism on the legislative front. Instead, start mass campaings of letter writing to DoS, Employers, Corporations, and Yes, law makers, both Congressmen and Senators.
