FIRST GUN CONTROL, now fuel economy. Congressional Democrats still have a lot of work ahead to get their groundbreaking bills past both houses and the president's desk, but you can't say they're not leading a radical change in direction.
On June 13, the House passed what could become the first major gun-control law in a decade, a bill aimed at strengthening a federal database used in background checks for gun buyers. A week later, the Senate approved an energy bill that would improve mileage for the nation's automotive fleet for the first time in nearly 20 years. Democrats still haven't forced a troop reduction in Iraq or put their stamp on the nation's backward immigration policies, but their surprising success in other areas is worthy of praise.
Not that Democrats deserve all the credit. The gun bill was a bipartisan effort that passed by acclamation after it won the blessing of the National Rifle Assn., while 20 Republicans � nearly half the 43 who voted on the measure � backed the fuel economy bill. Still, these measures would have been inconceivable while Republicans controlled both houses during the first six years of the Bush administration, a period characterized by the disgraceful decision to allow a decade-old assault weapons ban to expire in 2004 and successive energy bills focused on maximizing fossil fuel production at the expense of the environment.
It would be nice to think that the broad Republican support for a progressive energy bill signaled a pro-environment change of heart. Unfortunately, it probably has more to do with the high price of oil; Republicans are feeling pressure to bring gas prices down. They also rightly see dependence on foreign oil as a national security issue. The fuel economy bill would increase the average mileage requirement for cars sold in the U.S. from 25 miles per gallon to 35 by 2020, expected to eventually save millions of barrels of oil a day.
Regardless of their motives, Republicans' support for the energy bill will increase pressure on President Bush to sign it, assuming it gets through the House. Bush favors better fuel economy but wants it to come at a slower pace, with loopholes to allow more gas guzzling by SUVs. The Senate energy bill has its own regrettable loophole: A strong mandate was watered down in committee, allowing federal regulators to cancel the improvements if they decide the tighter standards aren't "cost-effective." But senators beat back furious efforts by the auto industry to weaken the bill further.
There was one sour note to last week's passage of the energy bill: An amendment that would have required the nation to get 15% of its electricity from renewable sources was defeated. Senate leaders should revive it in the future.

I have a certain labor category approved 19-#### and AOS is applied . Now the job I am looking at moving to has the same number (19-####) but the job duties are not exactly same. Will this be OK for AC21 or will I have problems?

My sister's H1B petition was approved on 2008 and she was unable to travel US for the past 1.5 year.
She is working in a MNC company in India. Now, she came to US on her B1 visa 1.5 month back. Meanwhile, she got an offer from a client in US and she want takeover the new job on her approved H1.
So, can you please let me know whether the employer (whoever filed my sister's h1) can file the H1B amenment while she in US with B1 visa and having H1B approved petition? If so, how many days she has to wait to get the approved amenment to start her work at client place? The employer is going to do the premium payment so that can we assume the amenment will be approved for sure?.
The LCA is really required for H1amenment? Please advice. This is really urgent.

hI ATTY I am working under an h1b visa right now as of 2011. But i had a previous petitioned by another employer way back 2006. There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case?? Please help me. Thanks

What are people's guesses on how many of the BEC labor certifications will be rendered effectively useless because of this?
Also, does this mean it will be more straightforward to port PD after I140 approval (because the old employer has no benefit to revoking I140 anymore?)?

Hi,
Please advice on my situation.
1)I was on L1 and applied for change of status from L1 to h4.once this was approved(I just saw the approval had not recieved any docs) i had to traval to India becos of my health.
2)while in India i gt 2 know that my H1 gt approved in may end (I797 A with new I-94).
as planned i came back with h4 stamped.
does this effect my h1 which valid from 1 oct 2010 in any way as I am currenly on h4 and plz advice what needs to be done to work from 1 oct
.please help.

My wife currently is on an H1-B visa and she also has EAD/AP based on my I-485 filing. Due to personal reasons she plans to quit her job soon (next 2-3 weeks or so). What will be her status? Should we be filing COS to H-4? Can we get a RFE for proof of her employment when I-485 is processed?

Hi,
Following are my USA stay details on L1 and H1-B visa:-
1) Stayed in USA from 01-SEP-2003 till 25-JAN-2004 on L1 visa(expired now).
2) Stayed in India from 26-JAN-2004 till 01-NOV-2004.
3) Stayed in USA from 02-NOV-2004 till date on new H1-B visa(still valid).
I read somewhere that 6 year period for H1 also counts L1 stay. Can someone please suggest, what should be my H1's final expiry date based on above details? Will that L1 stay be counted, even though I went back to India and came on a new H1-B visa?

Now he wants to come to US with new employer. What are the choices? As I know to transfer H1B to new employer he should be in US and with other documents like paystubs, SSN, etc.

My parents I94 is expiring on March 27th 2008.
We had filed for extension (form I 539) in California Service Centre with receipt date of Jan 02 2008.
Calif is currently processing Oct 2007 I529s.
My concerns are :
1) I think their stay here is legal till we hear back from USCIS on their extension. Please confirm if this is true.
2) If they get declined , they have to leave immediately. Is that period of stay considered illegal?
3) Is overstaying with legal extension an issue if they need to come again after 6 months or so? What is the criteria they look for for frequency of visits/stay periods at port of entry.
Will greatly appreciat all your personal experiences /wise opinion on this matter of pressing concern for us.

Tried to post in another, old thread - no response for several days, so decided to create a new one.
I asked my employer to create sub-account for me at http://www.plc.doleta.gov so I could check my PERM case status without polling them. The employer got back to me and said "looked into the site and I couldn�t find the way to create user account to view your case only".
They dont mind making sub-account for me, same way they do for attorneys and paralegals, but they dont want me to see their other pending cases or any information, unrelated to my case. So, my question is: is there a way to create sub-account, which would allow seeing my own case only?
